Finalidades del tratamiento de los Datos Personales

1. Asesoría, contratación, colocación, administración, cobranza y operación de servicios y productos financieros de Sabadell;
2. Verificar y confirmar la identidad del Titular como cliente; incluyendo procesos de verificación mediante el uso de datos biométricos en cumplimiento a la normatividad aplicable;
3. Realizar la verificación de los datos personales contenidos en la Credencial para Votar presentada por el titular a Sabadell, incluyendo la verificación de la biometría incluida en dicha credencial para asegurar que los datos coincidan con los registrados por el Instituto Nacional Electoral. Esta medida busca proteger los intereses del titular y prevenir el robo de identidad.
4. Verificar la capacidad de pago del Titular;
5. Realizar de estudios de mercado de manera disociada;
6. Integración y actualización de expediente del Titular;
7. Investigación de antecedentes crediticios, contratación y otorgamiento de créditos con o sin garantía, transacciones de operaciones financieras electrónicas a través del Sitio Web o de la Plataforma, gestiones de cobranza preventiva o judicial de créditos vencidos y no pagados;
8. Envío de mensajes relacionados con la funcionalidad, operatividad, promoción de los productos y servicios contemplados en el Sitio Web y/o en la Plataforma, con el propósito otorgar al Titular mejores beneficios;
9. Cumplir con las obligaciones y ejercer los derechos derivados de la relación jurídica entre Sabadell y el Titular;
10. La atención de requerimientos de cualquier autoridad competente;
11. La realización de consultas, investigaciones y revisiones con relación a cualquier queja o reclamación por los servicios y productos financieros que presta Sabadell, y
12. Realizar las gestiones correspondientes con el propósito de que los Datos Personales en todo momento se mantengan actualizados, correctos y completos, en cumplimiento al principio de calidad considerado por la LFPDPPP, su reglamento y normatividad secundaria aplicable;
13. Contactar a través de llamadas telefónicas, envío de comunicaciones a través de correos electrónicos, mensajes cortos, y demás medios de comunicación físico y/o electrónicos para gestiones de cobranza y cualquier situación relacionada con el uso y gestión de los servicios y/o productos, así como para informarle sobre cualquier beneficio al que se hubiere hecho acreedor.
14. Llevar a cabo actividades de prevención de operaciones de Prevención de Lavado de Dinero y Combate al Financiamiento del Terrorismo;
15. Cumplir con disposiciones aplicables en materia de Prevención de Lavado de Dinero y Combate al Financiamiento del Terrorismo.
16. Solicitar referencias bancarias, comerciales y personales sobre usted;

1.  Para identificarle y acreditar su identidad;
2. Para realizar las gestiones necesarias para efectos de formalizar la relación jurídica con la sociedad y/o persona de la que usted es representante y/o accionista;
3. Para verificar que cumple con los requisitos y condiciones contemplados en nuestras políticas de cumplimiento y anticorrupción; 
4. Para validar que cumplen con los valores empresariales y código de ética de la empresa;
5. Para la realización de auditorías internas y externas;
6. Para atender requerimientos solicitados por las autoridades competentes y  Fideicomisos Instituidos en Relación con la Agricultura (FIRA) que, en el ámbito de su control y especialidad, lo requieran mediante una solicitud fromal de información.
7. Para atender conflictos jurídicos promovidos ante las autoridades competentes.
8. Para realizar todas y cada una de las actividades propias para gestionar la relación pre-contractual, y, en su caso, contractual.

1. Elaborar perfiles de clientes y usuarios de los servicios y productos de financiamiento;
2. Enviar comunicados relacionados con ofertas, mensajes promocionales, comunicados con fines mercadotécnicos, publicitarios y de prospección comercial respecto de los servicios y productos antes referidos, nuevos o existentes;
3. Promocionar en periódicos, revistas, medios visuales, televisión y redes sociales los productos y/o servicios financieros, beneficios adicionales, descuentos, promociones, bonificaciones y concursos, para lo cual, Sabadell podrá utilizar los Datos Personales como son: nombre, fotografías, videos, entrevistas, publicaciones y cualquier otro medio de publicidad conocido o por conocer, y
4. Aplicar encuestas, estudios de mercado, participar en eventos, concursos, trivias, juegos y sorteos, participar en redes sociales, chats e información que nos permita evaluar la calidad de los productos y/o servicios financieros.

Transferencias

• Autoridades competentes en los casos previstos por la normatividad aplicable;
• A sociedades controladora o a las subsidiarias, accionistas, filiales, afiliadas o sociedades integrantes del mismo grupo de Sabadell, para llevar a cabo las finalidades antes establecidas, cuando Sabadell requiera de su apoyo para la prestación de sus servicios y/o productos o cuando Sabadell celebre fusiones y/o escisiones en las que dichas sociedades se vean involucradas.
• A entidades financieras y terceros con los que tengamos celebrados acuerdos jurídicos vinculantes para la adquisición de cartera de clientes a fin de dar cumplimiento a las obligaciones derivadas de la relación jurídica con usted. En el caso de entidades financieras sujetas a la Ley de Instituciones de Crédito y demás normatividad aplicable esta transferencia se realiza con fundamento en lo previsto en el párrafo segundo del artículo 93 de la citada ley.
• Aseguradoras o intermediarios de seguros a efecto de recibir los beneficios relacionados con los seguros contratados a través de Sabadell. 
• Al Instituto Nacional Electoral para verificar y validar la autenticidad de los datos y documentos proporcionados por el Titular y relacionados respecto de su identidad;
• A Fideicomisos Instituidos en Relación con la Agricultura (FIRA) para la atención de requerimientos de información y dar cumplimiento a obligaciones contractuales;
• A las Sociedades de Información Crediticia para verificar la calidad financiera y económica del Titular.

Revocación del consentimiento para el tratamiento de los Datos Personales

Limitación al uso o divulgación de los Datos Personales -Registro Público de Usuarios (“REUS”) de la Comisión Nacional para la Protección y Defensa de los Usuarios de Servicios Financieros (“CONDUSEF”)

Medio y Procedimiento para ejercer el derecho de acceso, rectificación, cancelación y oposición (los “Derechos ARCO”)

1. Nombre del Titular;
2. Domicilio y/o correo electrónico para comunicar la respuesta a la solicitud;
3. Fecha de contratación e importe del crédito otorgado por Sabadell y dispuesto por el Titular, conforme a las Finalidades Primarias del Aviso de Privacidad;
4. Los documentos que acrediten la identidad del Titular conforme a lo previsto en la LFPDPPP y su reglamento;
5. La descripción clara y precisa de los Datos Personales respecto de los que se busca ejercer alguno de los Derechos ARCO antes mencionados, y
6. Cualquier otro elemento, información o documento que facilite la localización de los Datos Personales.

1.  Cuando el solicitante no sea el Titular o la representación legal del mismo no esté debidamente acreditado para ello;
2. Cuando en la base de datos de Sabadell no se encuentren los Datos Personales;
3. Cuando se lesionen los derechos de un tercero;
4. Cuando exista un impedimento legal o la resolución de una autoridad competente que restrinja el acceso a los Datos Personales o no permita la rectificación, cancelación u oposición de los mismos, y
5. Cuando la rectificación, cancelación u oposición haya sido previamente realizada.

2. Verifying and confirming the identity of the Subject as a client, including verification processes through the use of biometric data in compliance with the applicable legal regulations.
3. Verifying the Personal Data contained in the Voting Credential the Subject displays to Sabadell, including the verification of the Credential’s biometrics to ensure that the data coincides with the data held by the National Electoral Institute, in the interest of the Subject and to prevent theft of identity materializes in any fraud or other crime to his detriment, as well as for the safeguarding of the public interest.
4. Verifying the payment capacity of the Subject.

9. Complying with the obligations and exercise the rights derived from the legal relationship between Sabadell and the Subject.

11. Carrying out inquiries, investigations, and reviews in relation to any complaint or claim for the financial services and products provided by Sabadell, and
12. Carrying out the corresponding procedures so that the Personal Data is kept updated, correct and complete at all times, in compliance with the quality principle considered by the PDPL, its regulations and applicable secondary regulations.
13. Contacting, through telephone calls, sending communications through emails, short messages, and other physical and/or electronic means of communication for collection efforts and any situation related to the use and management of services and/or products, as well as to inform you about any benefit to which you have become a creditor.

15. Complying with applicable provisions regarding the Prevention of Money Laundering and the Fight against the Financing of Terrorism.

2. To carry out the necessary steps to formalize the legal relationship with the company and/or person of which you are a representative and/or shareholder.
3. To verify that you comply with the requirements and conditions contemplated in our compliance and anti-corruption policies.

Transfers

Sabadell may transfer your personal data to national or foreign entities without requiring your consent to the following third parties and for the following purposes:

• Competent authorities in the cases provided for by the applicable regulations.
• To holding companies or subsidiaries, shareholders, affiliates, affiliates, or companies that are members of the same Sabadell group, to carry out the aforementioned purposes, when Sabadell requires their support for the provision of its services and/or products or when Sabadell celebrates mergers and/or divisions in which said companies are involved.
